STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eight

AN ACT relative to home education of children.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Home Education; Notification. Amend RSA 193-A:5, I to read as follows:

I.(a) Any parent commencing a home education program for a child, for a child who withdraws from a public school, or for a child who moves into a school district shall notify the commissioner of education, resident district superintendent, or principal of a nonpublic school of such within 30 days.

(b) Any parent planning to continue a home education program under subparagraph I(a) shall notify the commissioner of education, resident district superintendent, or principal of a nonpublic school no later than August 1 of each year.

2 New Paragraph; Home Education; Notification. Amend RSA 193-A:5 by inserting after paragraph IV the following new paragraph:

V. Prior to the initial year of a home education program, a parent shall provide to the department of education, resident district superintendent, or principal of a nonpublic school, information which summarizes planned and supervised instructional and related activities, including a curriculum demonstrating instruction in science, mathematics, language, government, history, health, reading, writing, spelling, the history of the constitutions of New Hampshire and the United States, and an exposure to and appreciation of art and music.

3 Home Education; Records; Evaluation. Amend the introductory paragraph of RSA 193-A:6, II to read as follows:

II. The parent shall provide for an annual educational evaluation in which is documented the child’s demonstration of educational progress at a level commensurate with the child’s age and ability by selecting one of the 4 evaluation methods in this paragraph and notifying the department of education, resident district superintendent, or principal of a nonpublic school of the method selected within 30 days. The child shall be deemed to have successfully completed his or her annual evaluation upon meeting the requirements of any one of the following:

4 State Board; Definition. Amend RSA 189:1-d, IV to read as follows:

IV. “Average daily membership in residence” means the average daily membership in attendance of pupils who are legal residents of the school district pursuant to RSA 193:12 or RSA 193:27, IV and are attending any public school, or who are attending any charter school [or], private school, or home education program approved by the department of education at the expense of the school district.

5 State Aid to Education; Definitions. Amend RSA 198:38, VI to read as follows:

VI. “Average daily membership in residence” means the average daily membership in residence of pupils in kindergarten through grade 12, as defined in RSA 189:1-d, IV of the second school year preceding the year in which the calculation is made, provided that no kindergarten or home educated pupil shall count as more than 1/2 day attendance per calendar day.

6 Effective Date. This act shall take effect July 1, 2008.

SB 337-FN - FISCAL NOTE

AN ACT relative to home education of children.

FISCAL IMPACT:

The Department of Education states this bill may increase state education trust fund expenditures and local revenue by $11,540,750 in FY 2010, $12,118,450 in FY 2011, and $12,722,650 in FY 2012. There will be no fiscal impact on state and county revenue or county and local expenditures.

METHODOLOGY:

The Department of Education states this bill includes home educated students in the definition of average daily membership in residence (ADM-R). The Department states the average per pupil education grant in FY 2008 is $2,650 ($527,360,567 / 198,968.9). The Department estimates additional state expenditure and local revenue that would result from including home educated students in ADM-R by multiplying the per pupil amount by the estimated number of home educated students. Adding home educated students to ADM-R will not affect FY 2008 or FY 2009 education grants determined pursuant to Ch. 263:35, Laws of 2007.
