programmer, and engineer. Mr. Caplener is available to resolve disputes
among litigants where the controversy involves law, technology, and intellectual
property. His goal is to provide a fair, impartial, prompt, cost-effective,
and final resolution of complex disputes. Mr. Caplener's

arbitrator may be arranged by contacting
the administrative personnel or his office directly. His services
also may be arranged by contacting the American Arbitration Association
(AAA).
Arbitration Philosophy
Arbitration is regarded as a private,
less expensive, and more efficient dispute resolution process than that
provided by State and federal courts. Mr. Caplener agrees with that
premise. He impartially resolves disputes in compliance with applicable
law in the fastest, fairest, and most cost-effective manner that circumstances
permit. To the extent possible, he will resolve the dispute with
one preliminary telephone conference followed by a hearing on the merits.
Complex cases may require additional preliminary conferences.
Conflicts Check
Prior to appointment on any case,
Mr. Caplener performs a check for actual and potential conflicts of interest.
If any are discovered, they are promptly reported. Administrative
personnel perform a similar check.

He is available to serve as an arbitrator within the San Francisco Bay
Area, and elsewhere.
