Rules Selection Policy
Mr. Caplener prefers to use arbitration
rules selected by the parties in shaping the dispute resolution process.
During the resolution process, each party, its counsel, and the arbitrator
will work towards final resolution of the dispute in conformity with the
chosen rules set. Some disputes may require application of rules
from the American Arbitration Association. Other disputes may require
application of rules from various forums, such as federal, state, or local
court arbitration rules. In the absence of an agreed upon set of
arbitration rules, Mr. Caplener suggests the
Caplener Rules be applied to expedite the dispute resolution process.
Panel Composition
Mr. Caplener may serve as a single
arbitrator or as a member of a three person arbitration panel. The
actual number of arbitrators is often specified in the underlying agreement
among the parties giving rise to the underlying dispute.
