Captain James M. May was captain of one of the 6 companies in the Hardy Co. Militia, called the "Hardy Grays." They were called into service in 1861 for the state of Virginia. (McMaster, The History of Hardy County, 1786-1986.)

Later Captain May was a Pvt. in Company B., William H. Harness Co., 11th Virginia Calvary, Laurel Brigade, Army of Northern Virginia. (Armstrong Regimental Histories series. E. L. Judy)

A document, "Special Presidential Pardons Of Confederate Soldiers," from The White House, lists James May as a recipient of a pardon; presumably for fighting as a Confederate Soldier.
