Papers related to the Estate of John W. Land

Elizabeth R. Germany, the only daughter of James Germany, married a man named Nathan Land and had a son, John W. Land. John Land died without any heirs, so his estate was divided among his deceased mother's brothers. In the event a brother had also died, his 1/7th portion was divided among his children. Elizabeth had 8 brothers, but one of them, Jacob C. Germany, preceeded her in death and left no heirs, so it seems his portion was turned back into the whole rather than left to his widow (perhaps she had remarried by then??). The records of Amite County, MS, provided a tremendous amount of information about family lines as John's uncles and cousins (the children of John's deceased uncles) laid claim to the estate. The branches in different locations seem to have deeded Power of Attorney to one individual in each geography to represent them in dealings with the administrator of John Land's estate, Charles C. Germany, who was a son of Robert Germany and a cousin of John Land.

Know all men by these presents that we Sarah J. Hughs and David Hugs her husband & Addie A Hughes and Wm A Hughes her husband, all of the County of Leake State of Mississippi being heirs at Law of the Estate of John Land late of Amite County in said State of Mississippi, now deceased in right of the said Sarah J Hughes & Addie A Hughes who are daughters of John Germany late of Neshoba County said State of Mississippi, now deceased who was a brother of Elizabeth Land late of said Amite County deceased who was mother of the said John Land deceased the said Sarah J and Addie Hughs being cousins of the said John Land deceased and heirs and distributors of the Estate, the said John Land having died leaving no heirs surviving him near a kin than that of cousins or ____ in the 4th degree - and having full confidence in our brother Willis Germany of Amite County in Mississippi (have constituted and appointed and do hereby nominate, constitute and appoint the said Willis Germany to be our lawful attorney for us and in our stead & name to receive any and all monies that is now or hereafter may be coming to us or either or any of us from the Estate of the said John Land deceased in the hands of his representative or in whose hands so ever the same may be found and to receive and receipt for the same as fully to all intents & purposes as we ourselves could do if personally present according to ourselves, and if necessary employ counsel, sign (?) hands in any matter necessary or _____ in suits or other proceedings in and about the premises and to act in all matters for us to the fullest extent for the purpose of obtaining for us our distributive part of the Estate of the said John Land deceased and to give refunding bonds and signs our names therein if necessary - Hereby fully ratifying all the acts of our said attorney _____ in & about the premises.

Personally before me the undersigned Justice of the Peace within & for the County & State aforesaid appeared Sarah J Hughs, David Hughs, Addie A Hughs & William A Hughs who severally acknowledged that they did sign seal & deliver the foregoing Power of Attorney for the purpose therein specified as their voluntary act and Deed, And the said Sarah A Hughs & Addie A Hughs on a private examination in separate from their said husband after the same was fully explained to them then & there acknowledged that they did sign seal & deliver said Power of Attorney ___ ____ voluntary act and deed without any fear threats or compulsion of their said husbands and that they are ____ satisfied with the same.

Know all men by these presents that I Henry I. Germany of the State of Louisiana, for and in consideration of the sum of One hundred dollars to me in hand paid by Robert H[.] Germany of the County of Amite and State of Mississippi, the receipt whereof I the said Henry I[.] Germany do hereby acknowledge, and do by these presents, give grant bargain sell deliver and convey unto the said Robert H[.] Germany, and to his heirs Executors administrators and assigns all my right title interest claim and demand whatever present or future either at Law or in equity, in and to the Real Estate of John W[.] Land, late of said County of Amite and State of Mississippi, as one of the heirs at law of said John W[.] Land Deceased my interest in said Real Estate being one third of one seventh part of all the Lands tenements and hereditaments {?} of which the said John W.[.] Land died seized and possessed and all my interest in the Rents, issues and profits of said Lands and _______ - To have and to hold the said above described undivided interest in said Lands of said John W. Land Deed to him the said Robert H[.] Germany and to his heirs and assigns forever.

Know all men by these presents that I William J[.] Germany of the State of Mississippi and County of Kemper for and in consideration of the sum of Two hundred and sixty-five Dollars to me in hand paid by Robert H[.] Germany of the County of Amite and State of Mississippi, the receipt whereof I the said William J[.] Germany do hereby acknowledge and do by these presents, give grant bargain sell, deliver and convey unto the said Robert H[.] Germany, and to his heirs, Executors, administrators and assigns all of my right title interest claim and demand whatever present or future either at Law or in equity, in and to the Real Estate of John W[.] Land late of said County of Amite, and State of Mississippi, as one of the heirs at Law of said John W[.] Land Deceased, my interest in said Real Estate being one seventh part of all the Lands, tenements and heredilaments {?} of which the said John W.[.] Land died seized and possessed and all my interest in the rents, issues and profits of said Lands and _______ - To have and to hold the said above described undivided interest in said Lands of said John W. Germany legal guardian of Benjamin A[.] & M[.]A[.] Germany minor heirs of John Germany deceased and J[.]W[.] Germany and V[.]M[.] Germany major heirs of John Germany deceased do hereby nominate constitute and appoint W[,]H[.] Germany our lawful agent and attorney in fact to secure and take into possession any and all property or monies that may be coming from the Estate of John W[.] Land, of Amite County and State of Miss to the estate of the said John Germany deceased and to receipt for the same in our names and stead and the said legal acts of our said attorney shall be as binding upon us either in law or equity as if we were present to perform the same hereby satisfying all of our attorneys legal acts in the premises.
