Last Will and Testament of Robert Germany decd

In the name of God amen. I Robert Germany of Amite County, and State of Mississippi, being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do therefore make ordain publish and declare this to be my last Will and Testament. That is to say, First after all my lawful debts are paid and discharged, the residue of my Estate real and personal I give bequeath and dispose of as follows to wit: To my children Margaret E. Dickson[,] Albert S. Germany[,] Robert H. Germany[,] Charles C. Germany, Cornelia L. Bowman [,] and Harriet A. Germany the following named negro slaves to with Sophia[,] Edmond[,] Charles[,] Big Frank, Overton[,] and Big Ellen, (then money that purchased Big Ellen was for the girl Ellen sold to Mrs[.] E.S. Williams) to be equally divided between them after they the said children have satisfied their proportion of a debt due Judge E. McGehee for which the above named Big Frank and Overton are liable.
To Martha E. Dickson the negro girl Martha
To Albert S. Germany the negro girl Louisa
To Robert H. Germany the negro girl Amanda
To Cornelia L. Bowman the negro girl Cornelia

Provided however that the said children will take the above mentioned negros at the appraised value I bequeath and devise all the rest reside and remainder of my Estate both real and personal of whatever I may be possessed at my decease to my lawful heirs to be equally divided between them, share and share alike, also that the negro man Alfred be allowed the privilege of selecting hi own master or mistress among my lawful heirs.

So be my executor of this my last will & Testament hereby revoking all former wills by me made In witness whereof I have herewith subscribed my name and affixed my seal the eleventh day of April in the year of our Lord One thousand eight hundred and fifty nine.

In the Probate Court of said Count at September 1869[.] In the matter of a certain instrument of writing purporting to be the last will and testament of Robert Germany decd.

Be it remembered that at a term of the Probate Court of the County of Amite in the State of aforesaid begun on the record Monday in Sept. AD 1859. Personally appeared in Open Court Sylvanus Petty one of the subscribing witnesses to a certain instrument of writing purporting to be the last Will and testament of Robert Germany late of said County, deceased bearing the date the 11th day of April AD 1869 who having been first duly sworn in deposed & said that said Robert Germany signed published & declared said instrument as his last Will and Testament in the presence of himself & James F. Anderson on the day of the date whereof, that said Anderson is now dead & that testator was then of sound disposing mind and memory and more than 21 years of age and that deponent and said Anderson decd subscribed to said instrument as witnesses thereto, at the instance and request & in the presence of said Testator & also in the presence of each other on the day & year aforesaid

Loose Paper in the Settlement of the Estate

Your Petitioner shows that the following parties are interested in said Robert Germany’s Estate, and whom your Petitioner prays may be made parties to this proceeding, and _______ if to be found in Amite County, Mississippi, and that Publication be made in The Southern Herald, a news paper printed and published in the town of Liberty in said County and State for all the non resident parties interested in said Final account to appear on a day certain at the next July Term of this honorable Court to be held on the 3rd monday [sic] thereof, then, and there to show cause if any they can why said Final account should not be allowed as stated, said parties and residences are as follows viz.-

Let Summons be issued and publication be made according to Law for the above named parties, and in duty bondedwith ___ ____ ___

Newspaper Notice about the Settlement of the Estate

Records in the estate file show that an ad was run in The Southern Herald, a newspaper published by A.G. Stratton in Liberty, MS (Amite County) in consecutive weekly editions from May 12, 1893 through June 9, 1893. The publishing fees and Clerk's fees totaled $7.50. Included is a newspaper clipping that is transcribed below:

Chancery Notice.
THE STATE OF MISSISSIPPI,

To Sallie Germany, whose postoffice address is Nashville, Tennessee; Ira Bowman whose postoffice address is Alexandria, Louisiana; Mrs. M.L. Harvey, whose postoffice address is Darlington, Louisiana; H V Germany, Allens Germany, John Germany, Marion Germany and Willie Germany (a Minor without Guardian), whose postoffice address is Baton Rouge, Louisiana - Defendants.

YOU ARE COMMANDED to appear before the Chancery Court of the county of Amite, in said State, on the Third Monday in July, 1890, to show cause if any they can why the final account of Mrs. C.S. Germany, surviving Administratrix of the Estate of Robert Germany deceased, should not be audited and allowed, now on file in said Court, wherein you are defendants.

Given under my hand and the seal of said Court, this 9th day of May, A.D. 1893.
