Declaration of Nonconsent to Police Searches
Some people aren't aware that you do not have to let the police conduct a warrantless search on your person or property. In fact, some folks who are a lot smarter than me on this issue, such as Claire Wolfe, Boston T. Party, and Vin Suprynowicz recommend that you do not consent to police searches as a matter of principle.
You may ask why you should refuse to consent to a police search, since after all, you are a law-abiding citizen with nothing to hide. In order to answer that question, I'll ask you a question: what do you expect to gain from such a search? The answer is that you have nothing to gain from permitting the police to search your property, but you could lose everything.
Consenting to a search does not prove your innocence of a crime, since you are supposedly already innocent until proven guilty in this allegedly free country. Nor does witholding consent legally furnish the police with probable cause. So why do they do it? Because you might be stupid enough to give your consent for them to engage in a free fishing expedition.
In addition to not giving your consent to a free fishing expedition, it is recommended that you purchase a small tape recorder and keep it handy in your vehicle (you are most likely to encounter the police while operating your vehicle), in case the law enforcement officer decides to conduct a search without a warrant, probable cause, or your consent.
Claire Wolfe has advised that those concerned about their rights "post notices on Usenet or a listserve that all searches of your person or property will be involuntary and that you will never allow a voluntary search." In the spirit of that advisory, I have created this page for those who wish to make such a declaration. If you would like to have your name added to this page, please send me your declaration. It wouldn't be a bad idea to PGP sign your declaration.
