Write the offer to purchase
Before writing the offer to purchase, it is very important
that you have been at least pre-qualified or better yet pre-approved by a lender. This is one of the best
negotiating tools a buyer can have. It shows the seller that you are financially able to
purchase the home. After you have found the right home, it is time to prepare
the offer.
In Wisconsin, the offer to purchase is a five page document, plus
optional addendums. It covers all facets of the purchase process, such as:
- Purchase price- your offer may or may not be the
same as the asking or list price
- Earnest money deposit- money to show that your
offer is made in earnest
- Down payment- the amount is usually determined by
the type of financing
- Contingencies- protective devices in the sales
contract that let either the buyer or seller declare the sale null and void
under certain circumstances, i.e. financing, inspections, sale of buyer's
property
- Personal items you wish the seller to include and exclude
i.e. appliances, sheds, swing sets
- Closing and occupancy date- this is the date the
home is yours and you can move in and the seller moves out
- Time limit after which your offer will be null and void
Once you make the offer, I, as
your Buyer's Agent will present it to the listing agent and they in turn will
present it to the seller. The seller may do one of three things: accept it, counter it, or reject
it. If your offer is accepted, it is a legally binding contract. If not, we may
need to negotiate.
