nerdzalert is defined as any business, employee, representative, location, affiliate or any other agent or agency defined by the president of nerdzalert 965 Mining School Rd. State Road, NC 28676. Principal member and acting president being Toby Groce. As per the current "Operating Agreement" of nerdzalert, only said and current president may define any particular entity as nerdzalert. No other entity may claim services as nerdzalert unless approved by current president.
Alert!: These Terms of Service apply to any services rendered by nerdzalert. Services include all "in shop", "in home", and "virtual services" rendered by any recognized nerdzalert representative.
"In shop" includes, but not limited to, services rendered at any designated "shop" area of nerdzalert. Home offices, point of sale locations, and any location designated by the governing members of nerdzalert, being the primary "in shop" location. "In shop" can be expanded to include any location designated by management members, or other pre-approved representative of nerdzalert, of the regional nerdzalert center. Prices and services shall be rendered as though "in shop" in lieu of "in home", only if the designated, and appropriate, nerdzalert representative pre-defines such location as "in shop" before any services are rendered.
"In home" includes, but not limited to, services rendered by any designated nerdzalert employee "on site" in relation to a customer's home, business, or other area immediately accessible to the customer, but apart from the nerdzalert standard "in shop" designations. "In home" includes any location, by definition, where a customer designates nerdzalert's employees to meet and conduct services for said customer. This includes any geographical location, structure, or properties not immediately defined or approve as "in shop". "In home" services are billed using "in home" charges due to additional exeinditures incurred by nerdzalert for travel and other expenses that may be incurred in relation to, and in addition to expenses that would otherwise not exist "in shop".
"Virtual services" include, but not limited to, services rendered over the telephone, and over the Internet via virtual networking software (including Remote Desktop connections). Under these definitions, any customer who contacts nerdzalert via "virtual services" defined methods, is subject to charges for information or services rendered by any designated nerdzalert employee. Even if one of nerdzalert's representatives does not conduct any "in home" or "in shop" services for the customer, billing for services will occur.
Terms and conditions of service from nerdzalert:
IN SHOP
1: We here at nerdzalert will do our best to troubleshoot your computer problems using our "virtual services" method initially. Of course, these services will be billed accordingly. However, in some cases, because of problems beyond our control, or by customer request, it will be necessary to perform an "in shop" service.
2: You, the customer, agree beforehand that upon any service performed by nerdzalert on your computer, it is solely and completely your responsibility to perform any data backup. This includes the hard drive(s) in their entirety. Any data ranging from settings, personal documents, photos, music, software, and any other data in general will be backed up prior to our service. You agree that nerdzalert is in no way held responsible under any circumstances, including gross negligence on the part of nerdzalert, for the loss or corruption of any data, of any kind, or in any way, on your computer or any attached peripheral or device.
3: Due to the physical nature of certain pieces of hardware in your computer, such as read/write heads on the hard drive failing, nerdzalert is also not responsible for any failure of hardware of any kind, including gross negligence on the part of nerdzalert. We cannot be held reliable in any way in the case of failure of hardware while in our presence, during "virtual services", or any time after committing service on said computer.
4: Authorization will be required for any services provided. This authorization must come from a legal adult over the age of 18, and the confirmable owner of the computer. This also extends to requiring the owner to confirm satisfactory completion of services. If the owner of the computer, nor a representative of the owner, being over the legal age of 18, is unable to approve any "in shop" service and provide authorizations for work, services will be denied them. In such event, nerdzalert will bill the customer a $150 cancellation fee and reserves the right to refuse any future services to offending customer. If you waive any of these authorizations in any way at all, nerdzalert is not legally responsible for anything in any way regarding your computer or any other device you own.
5: In order to best serve your needs, nerdzalert must be contacted ahead of time for scheduling of appointments for "in shop" services. We will do our best to schedule a mutually convenient time during standard business hours (Monday-Friday 9AM to 5PM) to provide services. In the event of an emergency call requiring out of hours, or immediate response, nerdzalert will apply additional charges for compensation of inconvenience.
6: All services provided by nerdzalert are simply services. No parts, supplies, accessories, or other required equipment to complete any particular project are provided. In the event that you the customer are unable to provide all the necessary supplies for any particular service, nerdzalert may obtain the required item at an additional charge to you the customer. You understand and agree that nerdzalert is simply a technician labor service, and that we in no way provide supplies or parts for free.
7: We at nerdzalert in no way provide any warranties or guarantees on our services, or on any product that may be handled, distributed, or otherwise provided by our representatives. In the event of a product malfunction, you the customer is responsible for any warranty or guarantee processing via the product manufacturer. And, nerdzalert in no way assumes responsibility for any of its services in the form of legal responsibility, even in the case of gross negligence by the representative, for replacement, repair, or in any way concerned with the particular service.8: Under no circumstances shall nerdzalert, or any of its representatives, employees, agents, or agencies be liable to you or any other person for any damages, including without limitation any indirect, incidental, special or consequential damages, expenses costs, profits, lost savings or earnings, lost or corrupted data, or other liability arising out of or related to the services provided by nerdzalert and/or any of nerdzalert's representative, agents, or agencies, or out of the installation, de-installation, use of, or inability to use your computer equipment, hardware, peripherals, or the network as a result of the services provided hereunder. No one at nerdzalert shall be liable for any failure or delay in performance due to any cause beyond its control. If nerdzalert's ability to render services is impaired, in any way, by your failure to cooperate or circumstances beyond, or within the control of nerdzalert, nerdzalert may choose not to provide services, as well as bill the customer a $150 fee. Service can also be denied if dangerous or unhealthy conditions are present including possible code violations. For any un-installation services provided, nerdzalert shall not be responsible for repairing any damage or changes made to your residence.
9: By signing this form, or simply by contacting us with requests for service, you release nerdzalert from any loss, liability, or damage, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability that you, the owner, or lessee may suffer arising out of, or related to, the services provided by nerdzalert. This includes but is not limited to data loss or lack of function in any component or element of your computer system and/or peripherals, any changes or alterations to your residence (for example, changes to walls, baseboards, floors, etc.) as a result of nerdzalert, even in the case of gross negligence on the part of the nerdzalert representative, regardless of the warranties, disclaimers, and waivers particular service and shall constitute liquidated damages and are a reasonable estimate of damages to you.
10: We reserve the right to not stand behind, or remedy problems with our "in shop" or any other services for any length of time. You the owner agree that upon completion of the services agreed upon with nerdzalert that you take full and complete responsibilities for any other services needed.
IN HOME

Any furniture, possessions, or valuables that are damaged, or missing, as a result of, even in the case of gross negligence on the part of our representatives, a nerdzalert representative, are not the responsibility or legal problem of nerdzalert. You the customer are responsible for providing complete, unimpeded, and safe access to all areas the technician will be working in, and all equipment of any kind that he/she will be working on. You must also provide safe and adequate access to whatever electrical power supplies the agent/agencies may require. Any electrical wiring or services will not be conducted by a nerdzalert representative, those types of work are left to certified electricians. If the nerdzalert representative decides that any of these conditions were not properly met, services will be denied, and a $150 cancellation fee will be billed to the customer. In the event of such failure, nerdzalert reserves the right to refuse any future services to the offending customer.
6: Due to the fragile nature of some walls and/or home construction structures, nerdzalert cannot be held responsible for damages that may result, even in the case of gross negligence by the nerdzalert representative, while performing services. All damages will be deferred to the owner for repair. Including all costs and supplies.
7: Area of coverage for services is determined by the managing nerdzalert representative for the particular area of service. These areas are subject to change without notice. Any travel deemed excessive in relation to the area of coverage will be subject to additional travel expenses that will be accessed by the managing representative. Please contact us to determine your area, and if any additional travel expenses will be incurred. The agent/agency traveling to your "home" reserves the right to add travel expenses without prior notification, at any time, as determined by him/her to be necessary for distance or other considerations.

nerdzalert reserves the right to change its terms of service without notice or notification. And, as such, you the customer agree to any and all terms of service by dictated by nerdzalert simply by utilizing any of their services or visiting their physical locations or website.
